These Terms and Conditions apply to all bookings, purchases, sessions, workshops, parties, events and use of the Play and Paint Co website.
By using our website, making a booking, attending a session, purchasing a product or gift card, or participating in any Play and Paint Co activity, you agree to these Terms and Conditions.
If you are making a booking for a child or another participant, you confirm that you are authorised to accept these Terms and Conditions on their behalf.
About Play and Paint Co.
Play and Paint Co provides creative art experiences, studio sessions, workshops, parties and events for participants of different age groups. Participants create their own artwork using various art techniques, paints, mediums, materials and tools.
Our sessions are designed to be creative, playful and hands-on. While our team will provide guidance and assistance during sessions, each participant’s final artwork will vary depending on individual technique, choices and participation.
Bookings & Payments
All bookings must be made by a person aged 18 years or over.
By making a booking, you confirm that:

you are at least 18 years old;

the information you provide is true, accurate and complete;

you have authority to book on behalf of any participant (including children) included in the booking;

you have read and accepted these Terms and Conditions;

you are responsible for ensuring each participant complies with these Terms and Conditions.
A booking is only confirmed once deposit has been received and you have received booking confirmation from Play and Paint Co or our booking platform.
We may refuse, cancel or reschedule a booking where reasonably necessary, including due to staff availability, safety concerns, incorrect booking information, payment issues, illness, emergency, venue issues or circumstances outside our control.
Participant Age Requirements
Children must be at least 3 years old to attend Play and Paint Co sessions. Children under 3 years old are not permitted to participate in our sessions.
Children aged 3 to 18 must be accompanied and supervised by a parent, legal guardian or responsible adult aged 18 years or over for the full duration of the session, unless Play and Paint Co has expressly agreed otherwise in writing for a specific program. The accompanying adult is responsible for the child’s behaviour, safety, personal care and general supervision during the session.
Play and Paint Co staff may provide creative guidance and session assistance, but they do not replace the role of a parent, guardian or supervising adult.
Session attendance and arrival
Participants should arrive 10 minutes before their booked session.
If you arrive late, your session may still finish at the scheduled end time. We may not be able to extend the session or provide a refund, credit or partial refund for time missed due to late arrival.
If you do not attend your session and have not cancelled or rescheduled in accordance with these Terms and Conditions, your booking may be treated as a no-show.
Cancellations and Rescheduling Appointments
You may cancel or request to reschedule your booking up to 12 hours before the scheduled session start time.
Cancellations or rescheduling requests made less than 12 hours before the session start time may not be eligible for a refund, credit or reschedule, except where required by Australian Consumer Law or where Play and Paint Co agrees otherwise.
Requests must be made using phone or email and are only confirmed once acknowledged by Play and Paint Co.
No-shows are not eligible for a refund, credit or reschedule, except where required by law or where Play and Paint Co agrees otherwise.
Cancellations or changes by Play and Paint Co
Play and Paint Co may cancel, postpone or reschedule a session where reasonably necessary, including due to illness, staff unavailability, emergency, insufficient bookings, venue or equipment issues, safety concerns or circumstances beyond our control.
If we cancel a session, we will offer you a reschedule, credit or refund, depending on the circumstances and your rights under Australian Consumer Law.
Refunds and Australian Consumer Law
Nothing in these Terms and Conditions excludes, restricts or modifies any rights you may have under Australian Consumer Law or any other law that cannot be excluded.
Our cancellation and rescheduling policy applies to change-of-mind cancellations, late cancellations and no-shows. It does not limit any rights you may have where there is a major problem with our services or where consumer guarantees apply.
Where a refund is approved, it will be processed back to the original payment method where possible. Processing times may depend on your bank, payment provider or booking platform.
Prices and payment
All prices are listed in Australian dollars.
Prices may change from time to time. The price payable is the price displayed at the time you make your booking, unless there has been an obvious error.
Deposit payment must be made at the time of booking unless Play and Paint Co agrees otherwise.
If GST applies, prices will be inclusive of GST unless stated otherwise.
Art materials, paints and other
Play and Paint Co uses water-based acrylic colours. We may also use optional additives and materials, including silicone oils, colouring sprays and other art-related products. These materials may stain or damage clothing, shoes, accessories, bags, personal belongings, skin, hair, nails or other items. Participants are responsible for following all staff instructions and using materials safely and appropriately.
Play and Paint Co provides personal protective equipment and protective clothing options for participants, which may include coveralls, shoes, disposable socks, gloves and, if requested or required, safety glasses. Participants are required to wear provided protective equipment or clothing during the session.
If a participant refuses to wear or change into the provided protective equipment or clothing, Play and Paint Co is not responsible for any paint, staining, marks, damage or wear to the participant’s clothing, shoes, accessories or personal belongings.
We recommend that all participants wear comfortable clothing suitable for messy art activities.
Health, allergies and medical information
The person making the booking must tell Play and Paint Co before the session about any relevant allergies, medical conditions, skin sensitivities, disabilities, accessibility needs, behavioural needs or other information that may affect the participant’s safety or participation.
This includes, but is not limited to, allergies or sensitivities to paints, gloves, cleaning products, latex, food, silicone oil, dust, fragrances or other materials.
Play and Paint Co will take reasonable care but cannot guarantee an allergen-free environment.
Participants should not attend a session if they are unwell, contagious or have symptoms that may put staff or other participants at risk.
Safety and Behaviour
Participants must follow all reasonable instructions given by Play and Paint Co staff.
Participants must behave respectfully and safely towards staff, other participants, guardians, property, equipment and the studio environment.
Play and Paint Co may remove or refuse participation to any person who:

behaves aggressively, abusively, dangerously or disruptively;

refuses to follow safety instructions;
-
misuses materials, tools or equipment;
-
causes damage to studio property;
-
puts themselves, staff or others at risk;
-
appears to be affected by alcohol or drugs;
-
is not suitable to participate safely in the session.
Where a participant is removed or refused participation due to behaviour or safety concerns, no refund will be provided except where required by law.
You are responsible for any loss, breakage, damage or excessive mess caused by you, your child, your guest or any participant included in your booking, except to the extent caused by Play and Paint Co’s negligence or breach of law. We may ask you to pay reasonable cleaning, repair or replacement costs where damage is caused by misuse, deliberate actions, reckless behaviour or failure to follow staff instructions.
For the safety of everyone in the studio, the following rules apply strictly:

No running is permitted anywhere inside the studio at any time.

Children must listen to and follow staff instructions, and accompanying adults remain responsible for ensuring the children under their care follow these safety rules.
Personal belongings
Participants and guests are responsible for their own personal belongings.
Play and Paint Co is not responsible for lost, stolen, stained or damaged personal belongings, except to the extent caused by our negligence or where required by law.
Photography and video
Play and Paint Co may take photos or videos during sessions for internal, administrative, security, training or promotional purposes where permitted.
For promotional use involving children or identifiable participants, Play and Paint Co will seek consent from the relevant adult, parent or guardian.
You may tell us if you do not want yourself or a participant included in promotional photos or videos.
Customers may take photos of their own experience, provided they do not photograph or video other participants, children, staff or private areas without permission.
Play and Paint Co may use video surveillance cameras in and around the studio for safety, security, incident management, loss prevention and staff/customer protection. By entering the studio, you acknowledge that you and any participants included in your booking may be recorded by CCTV. CCTV footage will be handled in accordance with our Privacy Policy.
Gift cards, vouchers and promotions
Gift cards, vouchers and promotional codes are subject to any terms stated at the time of issue. Gift cards are valid for 3 years from the date of purchase. Gift cards must be redeemed before the expiry date and are not redeemable for cash, except where required by law. Lost or stolen gift cards may not be replaced unless Play and Paint Co agrees otherwise.
Third-party platforms and payment providers
Play and Paint Co may use third-party providers to operate our website, manage bookings, process payments, send communications and support our business operations. These providers may include Wix and payment processing providers.
Your use of third-party platforms may also be subject to those providers’ own terms, privacy policies and processing practices.
Intellectual property
All Play and Paint Co business names, logos, website content, photographs, text, designs, session concepts, instructions and materials are owned by or licensed to Play and Paint Co unless stated otherwise.
You may not copy, reproduce, distribute or use our intellectual property for commercial purposes without written permission.
Participants own their own completed artwork, subject to any limitations around drying time, collection, storage or delivery that may apply.
Limitation of liability
Nothing in these Terms and Conditions excludes, restricts, or modifies any rights, guarantees, or remedies you have under the Australian Consumer Law that cannot be lawfully excluded. To the maximum extent permitted by law, Play and Paint Co’s liability for a breach of any non-excludable consumer guarantee is limited, at our option, to re-supplying the creative session or paying the cost of having the session supplied again. Except where directly caused by our gross negligence, we are not liable for any indirect or consequential loss, loss of enjoyment, personal injury, or permanent staining and damage to clothing, shoes, accessories, or personal belongings arising from your participation in our sessions.
Force majeure
Play and Paint Co is not responsible for delay, cancellation or failure to perform where caused by events outside our reasonable control, including extreme weather, power outage, illness, emergency, government restrictions, venue issues, supplier issues, natural disaster or other unexpected events.
Where this occurs, we will act reasonably and may offer a reschedule, credit or refund depending on the circumstances and applicable law.
Changes to these Terms and Conditions
We may update these Terms and Conditions from time to time.
The version that applies to your booking is the version available on our website at the time of your booking, unless a change is required by law or is otherwise reasonable and notified to you.
CCTV and studio monitoring
Play and Paint Co may use video surveillance cameras in and around the studio for safety, security, incident management, loss prevention and staff/customer protection. By entering the studio, you acknowledge that you and any participants included in your booking may be recorded by CCTV. CCTV footage will be handled in accordance with our Privacy Policy.
Governing Law
These Terms and Conditions are governed by the laws of Western Australia. All parties submit to the non-exclusive jurisdiction of the courts of Western Australia.

We keep CCTV footage only for as long as reasonably necessary for safety, security, insurance, legal or business purposes, unless an incident requires the footage to be retained for longer.
